Musicality TV Limited (“Musicality”) operates this privacy policy (“Privacy Policy”) on their website (“Website”) which relates to all data collected. This Privacy Policy forms part of the Fans Terms And Conditions. Once you have agreed to our Fans Terms And Conditions, you have also accepted this Privacy Policy.

2. Personal Information Collection And Use

Musicality collects user submitted personal information such as name, mailing address, email address, telephone number and age to authenticate users, and to send notifications to those users relating to the Website. This data is not used by Musicality for any other purpose and is not shared with third parties unless you have specifically opted to do so during the registration process or subsequently.

3. Advertising

As a general policy statement, Musicality will not permit advertising on the Website and does not therefore share aggregated or personal data with advertisers. Artists may advertise on their band page and any data collection by them is guided by their privacy policy.

4. Non Specific Data

Musicality logs non-personally-identifiable information including IP address, profile information, aggregate user data, and browser type, from users and other visitors to the Website. This data is used to improve the Website, to analyze trends, to administer the Website, to track user movements around the Website and to gather aggregate demographic information about our user base. Musicality will not use the information collected to market directly to you. This non-personally-identifiable information may be shared with third-parties to provide more relevant services to users in aggregate. User IP addresses are recorded for security and monitoring purposes. 

5. Pixel Tags

Musicality uses pixel tags to tell us what parts of our Website are being visited and to measure the effectiveness of searches users perform on our Website. Pixel tags also enable us to send email messages in a format that customers can read. And they tell us whether emails have been opened to assure that we're only sending messages that are of interest to our customers. 

6. Use Of Pictures

User profile information including user pictures and first names are displayed to people in order to facilitate user interaction in the social networking component of the Website. Users full names are not directly revealed to other users.

Musicality may use a users’ email address to send updates, a newsletter or news regarding the Website. Musicality may include email messages which use a "click-through URL" linked to content on the Website. When a customer clicks one of these URLs, they pass through our web server before arriving at the destination web page. Musicality tracks this click-through data to help determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked do not activate links in the emails sent.

Musicality or a partner may occasionally sponsor a promotion. Users may be asked to provide personal information including name, email address or home address or to answer questions in order to participate. Musicality may transfer personal information to certain partners that you have explicitly requested to receive information from. When linking to another website, a user should read the privacy policy stated on that website. Our privacy policy only governs information collected on our Website. 

11. Social Networking

 Please be aware that whenever you post public information to chat rooms, profiles, message boards or any other public forum, that information can be accessed by the public and can in turn be used by those people to send you unsolicited communications. Musicality is not responsible for the personally identifiable information you choose to submit on the social networking components of the Website. Please think before you post any personal information online. 

12. Correcting Or Updating Or Removing Information

Users may modify or remove any of their personal information contained on the Website at any time by logging into their account. 

13. Opt In

When users first register to open an account with Musicality they will be asked to opt in to receiving updates or notifications. Users will also be asked to opt in to receive information from sponsors. Unless you have opted in you will not receive updates from us or information from sponsorship. By not opting in, your personal data may only be used to operate your account on the Website and as a method of contacting you. If you decide to change your opt in to an opt out at any time you may opt out by logging into your user account and editing your profile. All notification emails and Musicality newsletters also include instructions for opting-out of those communications in the future.

14. Opting In To An Artists Site

In addition to your choices about the use of your personal information held by Musicality, you will also be invited to opt in to an artists’ site on this Website. Such choices do not relate to the choices you made about personal information held by us about you. If you choose to provide your personal information to artists on the Website this is a matter for you and the artist. We do not have access to such personal information and likewise will not share the personal information about you with artists unless You expressly authorize it. 

15. Security

Website users accounts and artist accounts are secured by passwords created by them. Musicality takes precautions to ensure that account information is kept private such as encryption to protect private information that is stored within our database. Musicality takes reasonable steps to guard against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, and destruction, and we restrict access to personal information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. Please note that Musicality cannot guarantee the security of user or artist account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of account information at any time. Users are urged to take precautions to protect their personal data by changing passwords often using a combination of letters and numbers, and using a secure web browser.

Musicality reserves the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of Musicality or substantially all of its assets to that successor in interest. To help us provide superior service, your personal information may be shared with strategic infrastructure partners who will safeguard it in accordance with Musicality’s  privacy policy. Without limitation, examples of this may be (i) where Musicality improves its storage capacity and wishes to move all personal data or (ii) your personal information is shared with a partner we have commissioned to undertake a user survey. The personal information you provide to our payment processing provider is not shared with Musicality and is encrypted.  

17. Minors

Musicality does not permit people under the age of 16 to register as a user or an artist. This requirement is clearly posted during the registration process. Any records identified of users found to be 15 years or less will be deleted and their accounts closed.  

18. Changes In Our Privacy Policy

From time to time Musicality may make changes to its Privacy Policy. If we make changes, we will post them on our Website to make users aware of what the changes are so Users will always be aware of what information we collect, how we use it, and when we may disclose it. A user is bound by any minor changes to the Privacy Policy when she or he uses the Website after those changes have been posted. If, however, we are going to use users’ personal information in a manner materially different from that stated at the time of collection we will notify by posting a notice on the Website for 30 days prior to that change.
